The Hollywood producer is hoping a judge in NY will agree that all the criminal charges against him should be dropped - and that he can walk out of court a free man.
Weinstein is accused of raping a women in a hotel room in March 2013 and forcing oral sex on another woman in 2006 at his apartment in Manhattan.
Brafman says the case has been "irreparably tainted" by alleged police misconduct.
The prosecution's case against him took a blow two months ago when one charge was dropped thanks to his attorneys' successful argument that the case was tainted by a lead detective who allegedly withheld evidence.
He faces five felony charges: two counts of predatory sexual assault, one count of criminal sexual act in the first degree and one count each of first-degree rape and third-degree rape.
Weinstein's lawyer, Benjamin Brafman, calls it a "technical ruling" and says he's still confident Weinstein will be "completely exonerated".
"It's a disappointment", Brafman said outside the courthouse after the judge declined to dismiss the case.

Weinstein was one of Hollywood's most powerful figures when scores of women - including A-list actresses - came forward in 2017 to allege he had sexually assaulted them.
But six months later, the case against Weinstein appeared as though it might be in trouble.
But then, according to prosecutors, the detective failed to inform them about key differences in their stories - and told the friend that "going forward, "less is more" " and that she had no obligation to cooperate with law enforcement". "If these women testify strongly on the witness stand, Weinstein will lose". The reporting also detailed how Weinstein paid off accusers, including an Italian model who, while working with the NYPD, recorded Weinstein admitting he groped her.
Prosecutors also disclosed an allegation that Det DiGaudio urged the 2013 rape accuser to delete private material from her mobile phones before handing them over to the DA's office.
The torrent of accusations that first surfaced against Weinstein in October past year upended his career, and sparked a major reckoning about harassment in the workplace and the global #MeToo movement. Prosecutors said the material didn't pertain to Weinstein and the woman wound up not deleting anything.
Gloria Allred, who represents one of the women in the case, said "This indictment was based on evidence and testimony before the grand jury".
If convicted, Weinstein still faces a minimum of 10 years in prison.
