India's cabinet approved a decree making the procedure a punishable offence because the government had struggled to pass the law in the face of opposition in parliament, as well as demonstrations by sections of the Muslim population angry at what they saw as interference.
After the Supreme Court verdict, PM Modi's government introduced a bill criminalizing the practice and it was approved in December by the lower house of Parliament, where his party commands a majority.
But since the practice was still prevalent, a bill was brought to make it a penal offence.
He said the issue of triple talaq has continued "unabated", adding that the government had recorded 201 such divorces since the Supreme Court struck down the law previous year. Custody of minor children will remain with mothers and a magistrate can only grant bail to the husband after hearing from the wife.
Owaisi said that the ordinance is against the Fundamental Right of Equality. A woman can drop charges if her husband is open to a compromise. "Triple talaq is not an official divorce, it is a form of abandonment".
Disregarding resistance from political opponents and the Muslim clergy, the Union Cabinet cleared an ordinance on Wednesday to criminalise instant triple talaq on the ground that the controversial custom, declared unconstitutional by the Supreme Court, was still being used against women of the minority community.

According to the new amendments, while the law remains "non-bailable", the accused can approach the Magistrate to seek bail even before trial.
