Daniels, whose real name is Stephanie Clifford, and her hard-charging lawyer, Michael Avenatti, claim the deal is non-binding because Trump never signed it.
As you no doubt heard, the Federal Bureau of Investigation raided Cohen's office and home seeking a bunch of information, some of which related to the $130,000 he paid to adult performer Stormy Daniels.
Avenatti, who has offered a $131,000 dollar reward for information leading to the identity of the man, has moved to add a defamation allegation against Cohen for accusing Daniels of lying about the alleged affair and the purported threat.
Cohen's lawyer argued that because the criminal investigation overlaps issues in the lawsuit, Cohen's right against self-incrimination "may be adversely impacted if this case proceeds" because he won't be able to respond and defend himself.
He said the fact that Cohen had not filed a declaration regarding his Fifth Amendment rights was "a strategic, purposeful decision".
Michael Avenatti, a lawyer for Daniels, declined to say before the hearing what he thought might have prompted Cohen's concern about self-incrimination.
Were Cohen completely loyal to the president, Trump would have less to worry about. He has said neither the Trump Organization nor the Trump campaign was a party to the transaction with Daniels and he was not reimbursed for the payment. At the same time, Cohen is still fighting Daniels in court, which also doesn't seem to be going too well.

FBI agents raided Cohen's home, hotel room and office last week as part of what was ultimately revealed to be an ongoing criminal investigation into his business dealings.
Daniels wants to void a contract she signed days before the 2016 general election in which she agreed to stay quiet about her alleged 2006 affair with Trump.
The White House has denied the claims of both women, Stormy Daniels and Karen McDougal.
Cohen's attorneys have accused Daniels of violating the agreement's confidentiality clauses more than 20 times and said she could be liable for $1 million in damages for each violation.
Blakely countered by estimating that Avenatti had made 53 public appearances discussing Daniels' case.
"Mr. Davidson has been contacted by the federal authorities regarding the Michael Cohen probe in the Southern District of NY".
The dossier claims that Cohen met with Russian operatives somewhere in Europe, including Prague, to attend a meeting to "clean up the mess" created by public disclosures of other Trump associates' reported ties to Russia. Mr. Davidson was asked to provide certain limited electronic information.
