The officer, Jason Stockley, had maintained he shot at Anthony Lamar Smith five times because he thought Smith was reaching for a gun, but prosecutors argued Stockley planted the gun in Smith's Buick after it crashed. "What prosecutors worked to do was present evidence in court that they believe proved Stockley violated Missouri law when he shot Smith and then planted a gun in Smith's auto to justify the killing". Stockley opted for a bench trial, which was overseen by Veteran Circuit Judge Timothy Wilson and lasted from August 1 to August 9.
The judge who acquitted a white former St. Louis police officer in the death of a black man has a reputation among prosecutors and defense lawyers as being objective and thorough.
Activists vowed a Ferguson-like, drawn out protest if Stockley was found not guilty. Bianci holstered his weapon while standing by the driver's side of Smith's auto at the fast food restaurant where Stockley claims Bianchi yelled gun.
"While officer-involved shooting cases are extremely hard to prevail in court, I believe we offered sufficient evidence that proved beyond a reasonable doubt that Jason Stockley meant to kill Mr. Smith", Gardner said in a written statement.

Complicating matters, the judge said, airbags had deployed in Smith's vehicle, blocking views - of witnesses and cameras - of what was going on inside it. They also claimed a gun was not planted and that Stockley acted in self-defense and reasonably. He left the St. Louis police force in 2013 and moved to Houston.
The St. Louis Post-Dispatch published videos in 2016 that showed the high-speed vehicle chase, and the moment Stockley shot Smith five times.
